In a context of rising violence and long-lasting impunity, in 2008, Mexico's criminal justice system underwent a radical change from an inquisitorial model to an adversarial one, to make it more effective, transparent, and expeditious. The new system tasked judges with publicly determining the admissibility of forensic evidence, as well as assessing its technical quality and probative value—tasks for which they currently receive little to no training. With the aim of contributing to the consolidation of the adversarial model, a comparative framework—in the form of a checklist—of the analysis of fingerprints, DNA samples, and voice recordings was created. To do so, a review of the academic literature, published reports, and guidelines was performed. The collected data were synthesized and submitted to a panel of Mexican judges, who provided feedback on its adequacy. The framework focuses on the steps on which quality assurance of forensic evidence depends, organized in five discrete stages that span from the collection of samples at the scene of a crime to the presentation of evidence at trial, specifying the main technical criteria experts should state to allow a decision maker to examine its accuracy and reliability. Differences and commonalities among the three methods were identified, particularly in terms of how qualitative and quantitative analyses are performed in each. Besides its potential usefulness as an aid for judicial decision-making, the checklist could be a valuable resource for training programs aimed at judges, as well as quality assurance programs.  相似文献

Across established democracies, citizens express high levels of support for decision making via referendums. What drives these preferences remains yet unclear. In this article it is argued that, first, process preferences are less stable than previously assumed but vary substantially across policy proposals. Second, it is suggested that instrumental considerations play an important role in shaping citizens’ preferences for referendums. Specifically, citizens who favour the policy proposal or believe that they hold a majority opinion are expected to express more support for the use of referendums. An original survey was designed and conducted in the Netherlands (N = 1,289) that contains both between and within respondent variation across a range of policy proposals. The findings support these arguments: Both the desire for a specific policy change and the perception of being in the majority with one's policy preference relate to support for the use of referendums across policy proposals, levels of governance, and between and within respondents. This study contributes to a better understanding of process preferences by showing that these preferences have a non-stable component and that instrumental considerations play an important role in citizens’ support for referendums.  相似文献

Subjective decisions make human cognitive processes more susceptible to bias and error. Specifically, research indicates that additional context biases forensic anthropologists’ morphological analyses. To address whether metric analyses are also subject to bias, we conducted a pilot study in which 52 experienced osteologists measured a difficult-to-classify human femur, with or without additional contextual information. Using a metric sectioning-point sex-estimation method, participants provided a sex estimate for individual skeletal element(s) and, when given multiple elements, the combined skeletal assemblage. Control group participants (n = 24) measured only the femur. In addition to the femur, bias group participants (n = 28) either measured a female humerus and viewed a female-biasing photograph (n = 14) or measured a male humerus and viewed a male-biasing photograph (n = 14). We explored whether the experts in the different groups would differ in: (1) femoral measurements; (2) femoral sex-estimation conclusions; and (3) final sex-estimation conclusions for the skeletal assemblage. Although the femoral measurements and femoral sex estimates were comparable across groups, the overall sex estimates in the female-biased group were impacted by contextual information—differing from both the control and male-biased groups (p < 0.001). Our results demonstrate that cognitive bias can occur even in metric sex-estimation conclusions. Specifically, this occurred when the metric data and single-element sex estimates were synthesized into an overall estimate. Thus, our results suggest that metric methods are most vulnerable to bias when data are synthesized into an overall conclusion, highlighting the need for bias countermeasures and comprehensive statistical frameworks for synthesizing metric data to mitigate the effects of cognitive bias.  相似文献

Are politicians more rational decision makers than citizens? This article contributes to the ongoing debate by examining how politicians and citizens assess the fairness of the process leading to a controversial policy decision. It contains theories as to why it is tempting to match the favourability of policy decision with a fairness assessment of the preceding process, and how politicians and citizens differ in their approach to the task. Having derived three hypotheses, parallel scenario experiments are run in large samples of Swedish politicians and citizens, in which the outcome and fairness of a policy decision process are manipulated. As predicted, it is found that both politicians and citizens match the favourability of the decision with the assessment of the process, that these self-serving biases are stronger among politicians, and that policy engagement accounts for the group-level difference.  相似文献

In response to research demonstrating that irrelevant contextual information can bias forensic science analyses, authorities have increasingly urged laboratories to limit analysts' access to irrelevant and potentially biasing information (Dror and Cole (2010) [3]; National Academy of Sciences (2009) [18]; President's Council of Advisors on Science and Technology (2016) [22]; UK Forensic Science Regulator (2015) [26]). However, a great challenge in implementing this reform is determining which information is task-relevant and which is task-irrelevant. In the current study, we surveyed 183 forensic analysts to examine what they consider relevant versus irrelevant in their forensic analyses. Results revealed that analysts generally do not regard information regarding the suspect or victim as essential to their analytic tasks. However, there was significant variability among analysts within and between disciplines. Findings suggest that forensic science disciplines need to agree on what they regard as task-relevant before context management procedures can be properly implemented. The lack of consensus about what is relevant information not only leaves room for biasing information, but also reveals foundational gaps in what analysts consider crucial in forensic decision making.  相似文献

ABSTRACT

The 2014 Scottish Referendum gauged public opinion on the possibility of Scotland leaving the United Kingdom, raising significant questions about the legitimacy of claims to citizenship in the event of independence. Through a mixed methods survey, this study explored the ways in which citizenship emerged in popular discourse in the lead up to the Scottish referendum. Findings point to an emphasis in public discourse on a commitment to and participation in society, instead of the more traditional citizenship markers of ancestry, birthplace or residency. Data indicates a view of citizenship encompassing status and practice, while identity was framed in terms of more static notions of birthplace and ancestry. The salience of social participation was noticeably greater in respondents’ assessment of others’ potential Scottish citizenship than their own. Specifically, the study highlights the salience of relational aspects of citizenship in popular discourse, with an emphasis on social citizenship in preference to legal citizenship. The study constitutes a significant contribution to ongoing discussions about ‘participatory citizenship’ in the field of Citizenship studies, by providing much needed empirical data on social conceptualizations of citizenship.  相似文献

Medical opinions are often essential evidence in criminal cases but relatively little is known about the factors that impact forensic doctors’ decision making. This research examines the role and impact of having an alternative hypothesis while forming a medical opinion. A scenario-based experiment with forensic doctors (n = 20) was conducted. In two out of three scenarios, the existence of alternative hypotheses impacted the actual opinions reached, the confidence in the judgments and the perceived consistency with the plaintiff hypothesis. Investigative and legal actors should be aware of the possibility of biases and importance of having alternative hypotheses when requesting and evaluating medical opinions.  相似文献

With domestic violence (DV) at an all-time high, police departments are drastically underutilizing technology to combat DV. Currently, New York police departments complete a “Domestic Incident Report” at the scene of domestic incidents but fail to adequately facilitate support services. New York State should mandate a services component into police DV protocols, specifically by commissioning: (1) an application linked to DV organizations presented at the scene of domestic incidents; and (2) a gateway application to refer victims to the correct services. Such tools would allow for the rendering of more efficient support to DV victims in times of immediate crisis.  相似文献

In the face of the discourse about the democratic deficit and declining public support for the European Union (EU), institutionalist scholars have examined the roles of institutions in EU decision making and in particular the implications of the empowered European Parliament. Almost in isolation from this literature, prior research on public attitudes toward the EU has largely adopted utilitarian, identity and informational accounts that focus on individual-level attributes. By combining the insights from the institutional and behavioural literature, this article reports on a novel cross-national conjoint experiment designed to investigate multidimensionality of public attitudes by taking into account the specific roles of institutions and distinct stages in EU decision making. Analysing data from a large-scale experimental survey in 13 EU member states, the findings demonstrate how and to what extent the institutional design of EU decision making shapes public support. In particular, the study finds a general pattern of public consensus about preferred institutional reform regarding powers of proposal, adoption and voting among European citizens in different countries, but notable dissent about sanctioning powers. The results show that utilitarian and partisan considerations matter primarily for the sanctioning dimension in which many respondents in Austria, the Czech Republic, Denmark and Sweden prefer national courts to the Court of Justice of the EU.  相似文献

ABSTRACT

Do legislators and executives speak of data the same way when speaking about public sector data? Public management scholarship and public performance policies often emphasize data-driven decision making as the path to making government efficient and effective. Whether the public policy makers mean the same thing when they speak about data in discussions of data-driven performance and decision making is unknown. In this article, the authors present an analysis of the language of data in conversations about government performance. Two frameworks are identified for the role of data in public performance—the statesman’s and the scientist’s. A corpus-level analysis of over 30 years of government documents is used to demonstrate the differences between these two approaches. This research builds consciously on the work of previous scholars seeking to map the nuances of data-driven performance management policies in the U.S. federal government.  相似文献
